Mi+ Program Terms and Conditions (“Mi+ T&C”)

Mi+ (“Program”) is a loyalty program of Miramar Hotel and Investment Company, Limited and its subsidiaries’ (“Miramar Group” or “We”), a member of Henderson Land Group (“Group”) managed and operated by The Miramar Explorer Limited (“Company”) and is governed by the terms and conditions set out herein (“Terms and Conditions”) which may be amended by the Company from time to time. Upon becoming a member of the Program  (“Member”), the Member shall be deemed to have agreed to and be bound by all the Terms and Conditions of the Program. The Member is able to access the full terms and conditions of the Program via Mi+ mobile application (“App”) or miplus.com.hk. Membership of the Program (“Membership”) and Member privileges including the specific Terms and Conditions below are subject to the sole discretion of the Company and to the following Terms and Conditions:


1. Definitions

Unless otherwise specified, these terms should have the following meanings:


1.1. “Business Units” means -      Malls: Mira Place 1, Mira Place 2, Mira Place Tower A (collectively “Mira Place”);

  • Hotels: The Mira Hong Kong;

  • Restaurants: Cuisine Cuisine, Chinesology, Tsui Hang Village, Mue Mue, Yamm, COCO, Vibes, Daai Zaak (collectively “Mira Dining”)

  • MiraSpa;

  • Mira eShop;

  • Bombshell; and

  • Miramar Travel

The applicable “Business Units” are subject to change without prior notice.

1.2. “Participating Merchants” refers to any tenants, outlets, shops, stores, branches, merchants, websites, mobile apps or any other channels which participate in the Program at which Members can earn and/or use M Points and/or M Coins. The inclusion of eligible Participating Merchants is subject to the sole discretion of the Company and may change from time to time without any prior notice. Members may check the App or visit miplus.com.hk for the latest list of eligible Participating Merchants.

1.3. "Participating Partners" refers to any business partners with whom the Company has made arrangements for Members to earn and/or use M Points and/or M Coins. The inclusion of eligible Participating Partners is subject to the sole discretion of the Company and may change from time to time without any prior notice. Members may check the App or visit miplus.com.hk for the latest list of eligible Participating Partners.

1.4. “Membership Types” means different types of membership eligible for the Program.

1.5. “M Point(s)” refers to point(s)  granted to Members by the Company under the Program.

1.6. “M Coin(s)” refers to the coin(s) converted from M Point(s) which can be used at the Business Units, the Participating Merchants and/or the Participating Partners.

1.7. “Eligible Receipts” means one set of valid receipts in one single transaction consisting of the original machine-printed and matching electronic or mobile payment slip, issued by the Business Units, the Participating Merchants and/or the Participating Partners. Each set of receipts can only be registered once. Member and cardholder must be the same person.

1.8. “Eligible Spending” means spending by a Member at the Business Units, the Participating Merchants and/or the Participating Partners with eligible receipts and qualified spending amount (HKD100 or above). Only Eligible Spending made between the valid calendar period will be qualified for M Points earning. All eligible spending must be dated on or after 29 September 2025.

1.9. “Conversion Rate” refers to the conversion of every HKD1 in Eligible Spending into one (1) M Points in the Program for the Business Units (except Miramar Travel at a conversion rate of every HKD10 in Eligible Spending into one (1) M Points), the Participating Merchants and the Participating Partners, unless otherwise specified. M Points will be rounded down to the nearest integer in every single transaction and any cent in the Eligible Spending will not be counted. Each M Coin is converted from every 250 M Points. The Company reserves the right to adjust at any time without prior notice at its sole discretion.

1.10. “Rewards” refers to any products, services, benefits, privileges, promotions, offers, Rewards or the like offered or to be offered to Members by the Company and any third parties (including but not limited to Participating Merchants and/or the Participating Partners) from time to time.


2. Membership Eligibility


2.1. Customers must first register as Members of the Program through the App or Mira eShop by providing required information.

2.2. Any individual aged 18 or above is eligible to apply for Membership.

2.3. The registered member name must be the same as the one stated on the Hong Kong Identity Card, Passport, Birth Certificate, or any other official identification document.

2.4. Members must register a valid mobile number to receive an SMS verification code. Members must be the legitimate owner of the registered mobile number. The Company takes no responsibility for any undelivered SMS.

2.5. Members have a responsibility to inform the Company if Members have changed their mobile numbers via the App. If Members are found registered with the Program with a mobile number that they do not own legitimately, the Company has the right to suspend or terminate such Membership without any prior notice.  In such cases, all unredeemed M Points and uncollected Rewards in the Member’s account will be forfeited and become non-refundable without any prior notice. The Company will not be held liable for or responsible for compensating Members in any manner for any loss or damage due to any unauthorised access to the App for whatever reason including stolen or lost mobile devices and/or failure to inform the Company after a change of the registered mobile number.

2.6. Membership is granted to each Member on an individual basis and is non-transferable. A Member can only hold one Membership account, any duplicate applications will not be accepted. The Company may terminate any application at its sole discretion.

2.7. Members must ensure that the information submitted is authentic, accurate, complete, not misleading and without any element of fraud.

2.8. Members have the right to request access to and correction of any of their personal data established to be inaccurate. The Company will comply with any such request unless it may or is required to refuse to do so under the applicable laws and regulations.

2.9. Members are required to maintain strict confidentiality and security of their membership numbers, passwords, mobiles, as well as any QR codes generated representing M Coins and/or their Memberships. Members are fully responsible for any unauthorized use of their accounts, whether with or without their authorization, by any individual, including third parties. The Company will not be held responsible for any loss or damages incurred.

2.10. Staff of the Company are authorized to request Members to present a valid identification document to verify the accuracy of Member data displayed on their mobile devices.

2.11. The Company reserves the right to suspend or terminate any Membership without any prior notice if a Member uses or accesses without authority any accounts that belong to another person, or is found to be dishonest providing false information in his/her application for Membership, or be dishonest in exercising of Member privileges.

2.12. The Company shall have the right to audit a Member's account at any time without prior notice to the Member to ensure compliance with these Terms and Conditions, any terms and conditions of the Participating Merchants and/or the Participating Partners, and any other applicable rules, regulations or terms and conditions. During the course of an audit, a Member’s account may be temporarily suspended and a Member may not be permitted to access his account nor perform any transactions.

2.13. The Company may at any time without prior notice review the criteria for eligibility to the Membership. The Company reserves the right to modify the structure, benefits, contents and other features of the Program including but not limited to the App, conversion and expiration of M Points and/or M Coins, these Terms and Conditions, joining Programs of or having arrangements with new or other programs and termination of the Program, at any time without prior notice. Although the Company will use reasonable efforts to notify Members of corresponding changes to the Program and/or to these Terms and Conditions, it is the responsibility of Members to keep themselves up to date in respect of the Program and these Terms and Conditions. Any earning of M Point and/or using of M Points and/or M Coins by a Member will be deemed as acceptance of any such modifications. The Company will not be liable for any loss or damage resulting from any modifications to the Program, including but not limited to these Terms and Conditions.

2.14.    The App only supports iOS 15.1 or above, and Android 7 or above.


3. Membership Types


3.1. The Program consists of different Membership Types, subject to the Company’s decision and criteria, a Member may be offered promotions and/or Rewards according to different Membership Types by the Company, the Business Units, the Participating Merchants and/or the Participating Partners.

3.1.1. “Membership” – Customers will automatically become Members upon successful registration, and Membership has lifetime validity period until termination upon Members’ request or the Company’s decision. 

3.1.2.  “Mira Commune Membership” – Members who work at the Mira Place Tower A (“Office tenants”) or the Mira Place (“Tenants”) are eligible for joining Mira Commune Membership. To enrol, Members must provide their company/shop name, office/shop location, and job title on member profile on the APP. Upon registration, Members  are required to bring along their business name card, staff card or any proven documents containing both Members’ name, company name and office address to the Concierge of Mira Place (Mira Place 1 G/F) for the Mira Commune Membership activation. Upon activation, corresponding Member privileges will be assigned to the Member’s account automatically. Members must present a valid eMembership card (QR code) and/or respective eCoupons to enjoy the privileges.

3.1.2.1. General Terms of Mira Commune Membership

a.) The Mira Commune Membership is valid for two years on a rolling basis unless it is further renewed. Mira Commune Membership renewal notifications will be sent to respective Members before Mira Commune Membership expires. In the case of non-renewal of the Mira Commune Membership, any unredeemed privileges and/or eCoupons under such Mira Commune Membership would be forfeited and become non-refundable. Members would remain as  Members.

b.) Members should as soon as practicable notify the Company if there is any change of their employment status.

c.) Mira Commune Membership  is  non-transferable. eCoupons are not transferable unless otherwise stated.

d.) The Company reserves the right to terminate or suspend of either any Memberships or the Mira Commune Membership at any time if there is any violation of the Terms and Conditions of the Program or General Terms of Mira Commune Membership is being abused or operated fraudulently, remaining balance and eCoupons issued by the Mira Commune Membership in the Members’ account will be forfeited and become non-refundable.

e.) The Company has sole discretion whether to grant the Mira Commune Membership. The Company’s decision on whether to approve a Member to join the Mira Commune Membership is final, conclusive and binding. 

f.) The Company has the right to vary the application requirements of the Mira Commune Membership without advance notice.

g.) The Company may at its discretion (but has no obligation to) offer privileges of such kind or nature and subject to such terms and conditions as it may consider appropriate.

h.) Privileges which are available to Mira Commune members may include year-round privileges, and participation in events held by the Company, the Business Units, the Participating Merchants and/or the Participating Partners (with advance invitation and booking required).

i.) Participation in any kind of privileges, promotions, workshops and/or events offered to Mira Commune members (collectively “Promotions”) represents the Members’ understanding, acceptance, and willingness to comply with the terms and conditions of the Promotions.

j.) Individual terms and conditions apply for Promotions. Please refer to the respective Promotions for details. The Company, the Business Units, the Participating Merchants and/or the Participating Partners reserve the right to amend, cancel, or temporarily suspend any  Promotions and change the terms and conditions relating to Promotions without prior notice to Mira Commune members.

k.) The Company reserves the right to change or modify or amend or extend or terminate the terms and conditions relating to the Mira Commune Membership without prior notice.

l.) In case of dispute, the decision of the Company shall be final, conclusive and binding.


3.1.3. “Corporate/Association Membership” –  This membership is for selected corporate partners and/or associations and solely by invitation only. Eligible staff and/or members  of corporate partners and associations will receive an invitation link for Corporate/Association Membership registration. Upon registration and verification, corresponding Member privileges will be assigned to the Member’s account automatically. Members must present a valid eMembership card (QR code) and/or respective eCoupons to enjoy the privileges. The Company shall review the Corporate/Association Membership eligibility of individual Members and reserve the right to terminate or suspend his/her Corporate/Association Membership. Any unredeemed privileges and/or eCoupons under such Corporate/Association Membership would be forfeited and become non-refundable. Members would remain as Members.

 

3.2. Members shall be deemed to have accepted the Terms and Conditions, any rules and specific terms and conditions relating to the relevant Membership Types and the Program Privacy Policy including but not limited to his/her consent that his/her personal data shall be retained for the purposes stated therein during the Membership.


4. MiFam


4.1. Members can select to join designated “MiFam” page of the Participant Merchants and/or the Participating Partners on the App to be able to participate in Promotions and be entitled to receive specific privileges offered provided by such Participant Merchants and/or Participating Partners.

4.2. Upon joining the “MiFam” page of the Participant Merchants and/or Participating Partners , the Member shall be deemed to have agreed to and be bound by all the Terms and Conditions of MiFam.


4.2.1. General Terms of MiFam

a.) All eCoupons, Rewards, promotions, missions, etc under MiFam are published, offered and provided by the respective Participating Merchants or Participating Partners. The Company shall not be liable or construed as providing any guarantee as to the quality and availability of the products and/or service provided by any of the Participating Merchants or the Participating Partners, nor shall the Company be construed as making any representation regarding any promotion offered by any of the Participating Merchants or the Participating Partners. If there are any queries relating to any coupons, Rewards, promotions, missions, etc provided by a Participant Merchant or Participating Partner, please contact the corresponding Participating Merchant or Participating Partner directly.

b.) eCoupons, Rewards, promotions, missions, etc offered by the Participating Merchants or the Participating Partners are subject to further terms and conditions as respectively stated.  In case of any dispute, the decision of the Company and the Participating Merchants or the Participating Partners shall be final, conclusive and binding.

c.) The Company shall bear no liability if Members cannot perform a successful redemption of any eCoupons and/or the eCoupons is lost due to any circumstances, or of any promotion or service provided by the Participating Merchants or the Participating Partners.

d.) The Company reserves the right to change, suspend or terminate any eCoupons, Rewards, promotions, missions provided by the Participating Merchants or the Participating Partners or their applicable terms and conditions at its sole discretion without prior notice. In any event, The Company shall not be liable for any such change, suspension or termination and reserves the right of final decision in all matters and disputes.


5. M Points & M Coins

 

5.1. Earning M Points

5.1.1.  Once the membership account is activated, Members may, subject to these Terms and Conditions, use the e-Membership Card to earn M Points based on his/her eligible spending at, or according to the requirements or criteria as may be specified by and applicable to, any Business Units, Participating Merchants and/or Participating Partners.

5.1.2. To earn M Points, a Member shall present his e-Membership Card or provide his Membership number at the point of purchase or login to his/her member account on Mira eShop before checkout . The upper limit for M Points earning per member is 1,000,000 M Points on one single transaction day including bonus M Points. The maximum spending amount  for M Points earning is HK$300,000 from each Business Unit, Participating Merchant and/or Participating Partner on one single transaction day, unless otherwise specified.

5.1.3. For eligible spending from the Participating Merchants at Mira Place 1 & Mira Place 2,  Members can earn M Points by scanning of sales receipts and electronic payment slips via the “Receipt Upload Function” on the App within 14 days from the transaction date. Submission will be reviewed within 5 working days (Member should keep the original receipt and matching electronic slip in case they are required for review). Upon approval, M Points will be added to Member’s account automatically.

5.1.4. Using the “Receipt Upload Function” on the App, Member could upload one machine printed receipt and one matching electronic payment slip per transaction. The Eligible Receipt amount of single transaction must be HKD100 or above and limited by Conversion Rate. Each set of Eligible Receipt can only be registered once. Member and cardholder must be the same person. The maximum spending amount valid for each transaction is HKD30,000. If the spending amount of the receipt exceeds HKD30,000, Member needs to register the receipt at Concierge, Mira Place 1. The maximum spending amount for M Points earning via “Receipt Upload Function” per member is HK$100,000 on one single transaction day.

5.1.5. All uploaded Eligible Receipts must be clear images of merchant’s machine-printed receipts and electronic payment slips. An Eligible Receipts must contain the transaction date, the name of merchant, the amount of transaction, the receipt number, credit card number which card holders’ name matches with Member name and the address of the Business Units, the Participating Merchants and/or the Participating Partners. The Company reserves the right to photocopy and stamp on the receipts and register the information for verification purposes if necessary.

5.1.6. Members should ensure their mobile network is stable while uploading the images. The Company takes no responsibility for an unsuccessful upload in case of an unstable mobile network.

5.1.7. The M Points earned from eligible spending of Miramar Travel will be awarded to the Members’ account one (1) business day after tour/flight/cruise departure.

 

5.2. Spending eligibility of Earning M Points

5.2.1. For qualify spending at Mira Place1 & 2,  the list of Participating Merchants will be updated time to time without prior notice.

5.2.2. All eligible spending must be dated on or after 29 September 2025.

5.2.3. Reprinted receipts, receipts of banking service, monthly bills, mobile SIM card recharge, receipts of cash coupon or voucher purchase, any add-value service and EPS cash withdrawal are not accepted.

5.2.4. Receipts of any purchases or transaction through email or phone orders; online shopping, mobile APP are not accepted, unless otherwise specified.

5.2.5. Receipts of membership payments, tickets (including but not limited to concert tickets), purchases or transactions at banks, tuition, insurance, broker fees, currency exchange, parking fees, conference room rental at The Mira Hong Kong and Mira Moon, rental of exhibition venue or promotional venue at Mira Place, banquets and/or any bookings of 60 person or above are not accepted.

5.2.6. For Hotel qualified room stay, if more than one member stays in a room, only one of the members will be awarded M Points and/or benefits, as long as all other conditions for such award of M Points and/or benefits are satisfied, so long as the Member provides their Membership Number at the time of reservation or at check-in, stays in one of the reserved guest rooms, and pays for the charges. 

5.2.7.  Unqualified Spending

·      Any room rate related taxes, service charges, gratuities, fees (e.g. late cancellation fee or no-show fees for not checking in for guaranteed reservations even if the reservations were paid in full), mandatory or automatic charges and other applicable charges, including certain room and other taxes and fees that are not part of a qualifying all-inclusive room package rate; in certain limited cases, taxes, service charges, gratuities, and/or fees related to other incidentals charged to the room bill, as well as taxes, service charges and gratuities that are part of a qualifying all-inclusive room package rate, may be eligible for M Points;

Paid membership fee,  tickets (including but not limited to concert tickets), purchases or transactions at banks, tuition, insurance, broker fees, currency exchange, parking fees, conference room rental, rental of exhibition venue or promotional venue

 

5.2.8. Only actual payment counts, i.e. total spending excludes discounts/coupons/cash coupons/credit card rebates; for cash installment/deposits, only amount settled on the date of transaction counts. If the Member subsequently cancels a purchase, M Points earned from eligible spending for that particular transaction will also be cancelled.


5.3. M Points Validity

5.3.1.      Record of all successful transactions will be available in “Transaction History ” on the App for Member’s checking within 24 months.

5.3.2.      The two expiry dates for M Points each year would be 30 June and 31 December. The expiry date of M Points will be calculated by the date of transaction, instead of the date of M Point registration.

a.) M Points earned from 1 January to 30 June this year will expire on 30 June of the next year, and the expired M Points will be forfeited and become non-refundable automatically on 1 July of the next year.

b.) M Points earned from 1 July to 31 December this year will expire on 31 December of the next year, and the expired M Points will be forfeited and become non-refundable automatically on 1 January of the year after next.

5.3.3. M Points have no cash value. All expired M Points will be forfeited and become non-refundable upon the corresponding expiry date (i.e. 1 January and 1 July each year) and cannot be carried forward. No extension of M Points is allowed, and M Points forfeited due to expiration will not be re-issued/refunded under any circumstances.

5.3.4. The Company reserves the right to determine the validity and applicability of those invoices/receipts for M Points earned, and to withhold the use of the M Points that the Company suspects are not validly or properly earned or if the same is tainted with fraud or irregularity or mistake, the Company’s decision shall be final, conclusive and binding.

5.3.5. The Company may, at its sole determination, deduct from Member’s remaining M Points:

a.) which are suspected to be fraudulently or incorrectly recorded or earned by Member;

b.)  relating to a transaction which is cancelled or which does not exist;

c.) recorded in error; and

d.) which has already expired and cannot be used for redemption.

 

5.4. Rewards Redemption

5.4.1. Members can redeem Rewards with M Points on the App. Quotas of Reward may be applied, and redemption is on a first come, first serve basis while stocks last.

5.4.2. The redemption of Rewards must be requested within the period as specified in the relevant terms and conditions of the Rewards. The availability of Rewards and their approval for redemption are subject to the discretion of the Company.

5.4.3. Once redemption request has been confirmed and approved, the corresponding M Points will be deducted from the Member’s account automatically, Redemption request cannot be recalled/refunded once approved. If there are insufficient M Points in the Member's account, the Redemption Request will be cancelled.

5.4.4. Once redemption request has been confirmed and approved, the corresponding eCoupon will be added to the Member’s account. Redemption must be made within the specified period; late redemption will not be entertained.

5.4.5. Rewards cannot be exchanged for any kind of benefits, including but not limited to cash, M Points or M Coins.

5.4.6. Once Rewards have been redeemed, cancellation or refund of the Rewards will not be entertained.

5.4.7. The Company shall have no legal liability related to any aspects of the redemption items (including but not limited to premium liability, quality and maintenance) provided by the suppliers, and no compensation shall be offered by the Company.

5.4.8. The Company reserves the right to adjust M Points, cash and redemption quota required for Reward redemption. The Company might amend, suspend or cancel the redemption program and the terms and conditions involved without prior notice. In case of disputes, the decision of the Company shall be final, conclusive and binding.


5.5. Using M Coins

5.5.1.  Every 250 M Points can be converted into 1 M Coin, and each M Coin can be used as HKD1 instant cash to be spent in a transaction at a Business Unit, Participating Merchant and/or Participating Partner.

5.5.2. Business Units, Participating Merchants and/or Participating Partners designated at which Members may use M Coins to offset transaction amount, such Participating Merchants and/or Participating Partners are subject to the sole discretion of the Company and/or may change without prior notice. Members may visit the App and miplus.com.hk for the latest eligible list.

5.5.3. Members shall use at least 10 M Coins in one single transaction and decimal place is not allowed. M Points with the earliest expiry dates will be used first.

5.5.4. To use M Coins, Members are required to present the QR code representing M Coins to the respective Business Units, Participating Merchants and/or Participating Partners. Procedures for using M Coins may vary depending on the Business Units, the Participating Merchants and/or the Participating Partners. Members who wish to use M Coins at such Business Units, Participating Merchants and/or Participating Partners agree to be bound by the applicable procedures.

5.5.5. Once M Coins are used, the relevant M Points will be deducted from and shown in the Member’s account.

5.5.6. If a Member makes any transaction using M Coins (whether in full or as partial payment), such transaction cannot be refunded under any circumstances.

5.5.7. The Company is entitled to adjust the M Coins conversion rate at any time without any prior notice and/or to restrict or limit the number of M Coins a Member can use for each transaction.

5.5.8. M Coins cannot be exchanged for cash and may not be sold, purchased or transferred to any other Member or individual. Used M Coins cannot be reversed to M Points or be refunded under any circumstances.

5.5.9. If a Member has already used M Coins but it transpires that the Member did not have sufficient M Points or M Coins for such purpose for whatever reasons, the Member shall compensate the Company for any loss or damage suffered by the Company.

5.5.10. In case of dispute, the decision of the Company shall be final and conclusive and binding on all parties concerned.


5.6. M Points Conversion Program

5.6.1. To be eligible for the M Points and H·COINS Conversion Program (“Conversion Program”), customers must be members of both the Program and H·COINS and participate in the Conversion Program  via the App or H·COINS iPhone/Android App (“H·COINS App”). A reference to “Conversion Program Members” in these Terms and Conditions includes a person who is a Member of the Program and H·COINS.

5.6.2. 5,000 M Points can be converted into 5,000 H·COINS. The Company reserves the right to change or terminate the conversion without prior notice. Each Member can only participate in the Conversion Program three times per month, available on a first-come, first-serve basis.

5.6.3. Conversion is subject to M Points balance of the Member. A request for conversion will be automatically declined if M Points are inadequate or invalid.

5.6.4. No cancellation or change to other Rewards will be accepted upon confirmation. In no circumstances can M Points nor H·COINS be exchanged or converted to cash.

5.6.5. Conversion Program Member should check the redeemed M Points or H·COINS and other details of each conversion request carefully before sending the request. Conversion records of the Program and H·COINS shall be final and no claim of points after the conversion will be accepted. Neither the Company nor H·COINS accepts any liability for any loss which may be suffered by a Conversion Program Member arising from the failure or delay in obtaining the Conversion Program Member’s points information due to technical issues or any other abnormal system situations.

5.6.6. The Company and/or H·COINS reserve the right to amend the terms and conditions of the Conversion Program (including, without limitation, amending M Points and H·COINS needed for conversion and the Redemption Period) from time to time, or to terminate the Conversion Program without prior notice to Conversion Program Members.

5.6.7. Conversion Program Member expressly consents to the Program and H·COINS transfer between them the Conversion Program Member’s personal information for the purpose of the Conversion Program. Each of the Company and H·COINS will use and handle the personal information held by it subject to the Program Privacy Policy and H·COINS Privacy Policy Statement (https://www.hcoins.com.hk/pics/) respectively.

5.6.8. The Company and/or H·COINS reserve the right to terminate the Membership of any Member immediately if they are found to have registered M Points with counterfeit receipts, receipts stolen from another person or using the Member account (including but not limited to registering  Member account, M Points or redeeming Rewards) in any dishonest way. The Member’s M Points to redeem any Reward will be forfeited and become non-refundable, and entitlement to any Member privileges or Reward redemption will be revoked. The Company and/or H·COINS reserve the right to request a return of all redeemed Rewards and to lodge a claim for compensation of any losses suffered.

5.6.9. The Company and H·COINS are membership programs operated by their respective operators independently. For information about H·COINS ’s membership program or membership terms and conditions, please visit H·COINS official website or H·COINS App.

5.6.10. The Company and/or H·COINS reserve the right to amend the Conversion Program’s terms & conditions without prior notice. In the event of disputes, the decision of the Company and H·COINS shall be final, conclusive and binding.


6. Birthday Offers

 

6.1. Members will receive bonus M  Points for birthdays on the first approved Eligible Spending of M Point registration during the birthday month (which must be registered with the same birthday month as the identity document) (except Miramar Travel).

6.2. The bonus M points for the birthday will be automatically deposited into the Member's account on the same day. The maximum amount of bonus M Points that a Member can earn on birthday is 10,000 M Points.

6.3. The content, terms and conditions of Birthday eCoupon may be changed, amended from time to time upon Company’s decision.

6.4. Birthday Offers cannot be exchanged to cash, extend, or transfer to Members or individuals.

6.5. The Company might amend, suspend or cancel the Birthday Offers and the terms and conditions involved without prior notice.

6.6. In case of dispute, the decision of the Company shall be final, conclusive and binding.


7. Year Round Offers

 

7.1. Members can present their e-membership card via the App to the Business Units, the Participating Merchants and/or the Participating Partners to enjoy year-round offers. For details and related terms and conditions each year round offer , please see “Year Round Offers” section on the App.


8. Parking Privileges


8.1. Member must register his/her car plate number on “Parking” page on the App. Each Member can register up to three (3) car plate numbers. Each car plate number can only be registered by one member through the App. Members have the option to delete their validated car plate number(s) at any time through the App.

8.2. To activate the registered car, an SMS will be sent to the Members automatically when the Members first enter the Mira Place Car Park with the registered car, Members are required to activate the service via the URL provided on the SMS. In case no activation has been completed before exiting the car park, the service activation will be deemed cancelled, and member has to go through the process again.

8.3. In the event of a change-in-ownership of the registered car plate number in Member account, Members are required to remove the corresponding car plate record from the App. If a Member is found to have registered a car plate number that they do not legitimately own, the Company shall reserve the right to remove the registered car plate number without any prior notice.

8.4. The parking privileges for Members include, but are not limited to:

a.) Free parking eCoupon redeemed by M Points on the App;

b.) Free parking hour(s) redeemed via other parking promotions or complimentary parking coupons from tenants of Mira Place


8.5. Once free parking hour(s) has been redeemed, it can only be utilized for the current parking visit on the same day and cannot be used in future.

8.6. Hourly rates will apply when the free parking hour(s) end, partial hour is considered as full hour, free parking hour(s) count from entering and leaving the Mira Place Car Park. In particular, Day Park / Night Park Special will not apply.

8.7. Members can redeem free parking hour(s) by M Points through the App before exiting the car park. The car may leave the Mira Place Car Park within a grace period of 15 minutes after redeeming free parking hour (s) with M Points on the App successfully.

8.8. Unless otherwise specified, parking privileges cannot be combined with other parking offers.

8.9. Free parking hour(s) redeemed is non-cancellable, non-refundable and cannot be exchanged for cash or credits.

8.10. To redeem free parking privileges, members are advised to ensure that the redemption process has been successfully completed. No refunds will be provided for charges incurred due to an unsuccessful redemption.

8.11. Free parking is offered on a first-come-first-serve basis and is subject to the availability of parking spaces. The Company and/or Mira Place retains the right to alter, modify, or terminate the parking privileges without prior notice.

8.12. The Company and/or Mira Place will not be held liable for any loss or damage incurred or suffered by a member due to any third-party access to the App resulting from whether stolen or lost personal mobile devices or failure to remove the relevant registered car plate number from the  App after change of ownership of the registered car or otherwise.

8.13. The Company and/or Mira Place will not be held liable for any loss of or damage to any property (including any cars or any goods, articles or appliances inside or outside any cars) resulting from or in relation to car registration by Members.

8.14. Mira Place may from time to time restrict the use of the Mira Place Car Park or any part of it without prior notice. No refund or compensation will be made due to capacity limitations, or to ensure safety, security or order, or if Mira Place considers that the circumstances so require.

8.15. Mira Place reserves the right to establish, remove and/or revise the reservation fees, carpark charges or any other charges at any time in its sole discretion.

8.16. In case of dispute, the decision of the Company and/or Mira Place shall be final, conclusive and binding.

9. Parking Space Reservation Service


9.1. Members can redeem the  “Parking Space Reservation” with designated M Points. Once redemption is made, the corresponding M Points will be immediately deducted from the Member’s account. The M Points deducted will not be refunded or compensated in any form, regardless of whether the “Parking Space Reservation” service is ultimately used.  

9.2. Upon successful redemption,  Members are required to provide car plate number, car brand/model to staff of the Mira Place Car Park to reserve a parking lot.

9.3. Upon successful reservation, the valid time of the reservation will be displayed on the App. The reservation time of the “Parking Space Reservation” service starts from the time when redemption is successfully made on the App. Member is required to arrive at the Mira Place Car Park before the reservation expires.  

9.4. If the registered car arrives more than 1 hour after redemption, Mira Place reserves the right to release the parking space to other users without any form of compensation.

9.5. Mira Place reserves the right to establish, delete, and/or revise reservation fees, parking fees, or other charges as it deems fit.

9.6. In case of any disputes, decision of the Company and/or Mira Place shall be final, conclusive and binding. 


10. Usage of Mi+ personal data


10.1. The provision of personal data by means of Membership registration form is voluntary. Each applicant for Membership is required to supply all the personal data and other information requested in the Membership registration form (except those specified to be not obligatory) in order to enable the Company and the Group to consider his/her application. Failure to do so may result in the Company and the Group being unable to process the application. If the application is successful, further personal data and information may be collected during the period when a Member’s Membership continues.

10.2. It is entirely voluntary for Member to provide personal data which is not marked as “mandatory” in the Membership registration form.

10.3. Personal data provided by Member will be used by the Company and the Group for the purposes of:

a.) Processing any administration, continuation and termination of Membership;

b.) Processing any application for Membership;

c.) Assessing and/or verifying information supplied to the Company and the Group;

d.) Conducting research and/or analysis to understand customers’ needs so as to provide better facilities, services and/or products;

e.) Providing the Program or Members services, including providing privileges, benefits and other advantages to Members and rallying and arranging for the same to be provided by the Company and the Group, or any other firm, company, corporation, body or organization (collectively, a “Relevant Person”);

f.) Designing new and/or enhancing existing facilities, services and/or products offered by the Company and the Group, the Business Units, the Participating Merchants, the Participating Partners, or any Relevant Person from time to time;

g.) Encouraging feedback from Members on exclusive offers, facilities, services and/or products of the Company and the Group, the Business Units, the Participating Merchants, the Participating Partners, or any Relevant Person.

h.) Matching Member information, in connection with the purposes set out in the Terms and Conditions, against any data held by the Company and the Group for whatever purpose (whether or not with a view to taking any adverse action against the Member)

i.) Providing information related to the Member, including the products, facilities, services and other privileges, benefits, other advantages and promotional materials from time to time offered by the Company and the Group, the Business Units, the Participating Merchants, the Participating Partners, or any Relevant Person.

j.) Any other purpose(s) which has been agreed by or notified to Member.


10.4. The Company and the Group strives to preserve the confidentiality and security of all the personal information which the Company and the Group may collect. The Company and the Group shall have absolute right to disclose, transfer and/or exchange any such data and information to any and all of the following persons or entities for the purposes mentioned in 10.3:

a.) any member of the Company and the Group; and/or

b.) any Relevant Person; and/or

c.) any agent, contractor or third party service provider who provides administrative, computer, technology outsourcing, cloud services, payment, data processing, marketing and other services to Members in connection with the operation of our business and the provision of our facilities, services and/or products to the Members


10.5. The Company and the Group  will keep Members personal data only for as long as necessary to fulfill the purpose which the data was collected. The Company and the Group may also retain archived personal data for statistical purposes. Personal data which is no longer required will be destroyed.

11. Termination or Suspension of Membership

 

11.1. Members may terminate their Membership at any time by giving 30 working days prior written notice to the Company.

11.2. The Company is entitled to forthwith terminate or suspend the Membership of any Member at its sole discretion in case the Member breaches or is reasonably believed to have breached any of the Terms and Conditions, or fails to comply with the instructions of the Company. The Company reserves the right to forthwith terminate or suspend the Membership of any Member at any time at the sole and absolute discretion of the Company. The Company shall not be liable for any loss or damage incurred as a result of termination of the Membership suffered by any party under any circumstances.

11.3. The Company reserves the right to cancel all unused/unredeemed M Points/M Coins/Rewards if a Member forthwith upon termination of his or her Membership for whatsoever reasons without any liability or compensation.

11.4. Termination of Membership for whatever reasons shall not prejudice any accrued rights and remedies of the Company and the Group, the Business Units, the Participating Merchants and/or the Participating Partners as at the date of termination of Membership.

11.5. If there is any misuse of the Membership account, QR codes, M Points, M Coins, and/or Rewards, including but not limited to dishonest conduct, fraud and/or misconduct by a Member, the Company reserves the right to terminate or suspend the Membership or withdraw M Points and/or M Coins and/or Rewards from the Member without prejudice to any accrued rights and remedies of the Company against the Member.

11.6. Upon the death of a Member, his/her Membership account shall be closed and all unused M Points/M Coins/Rewards (if any) shall be forfeited and become non-refundable by the Company without any liability or compensation. Any balance of the M Points/M Coins cannot be transferred to any other person.

11.7. If a Member has earned M Points, used M Coins and/or redeemed Rewards for himself/herself through any suspected dishonest conduct, fraud and/or misconduct, the Member shall, without limitation, be liable to the Company and the Group, the Business Units, the Participating Merchants and/or the Participating Partners for the M Points/M Coins/the full value of Rewards or other goods and services obtained, together with all costs and damage incurred or suffered by the Company, the Business Units, the Participating Merchants and/or the Participating Partners resulting from such suspected dishonest conduct, fraud and/or misconduct.


12.    General Terms and Conditions


12.1. Eligibility for Membership is at the sole discretion of the Company. The Company may reject any application. The Company has the right to change the Membership types, invalidate or terminate the Membership or the Program at its sole discretion.

12.2. Activation and use of Membership will be deemed to be acceptance of all Terms and Conditions (including any subsequent amendments) of the Program.

12.3. Only customers who have completed the registration process via the App (which can be downloaded from App Store or Google Play) or Mira eShop to become Members of the Program can enjoy Member privileges.

12.4. The Company has the right to extend or terminate or change the structure, scheme, benefits, Rewards and other features of the Program, including but not limited to these Terms and Conditions, the App, M Points registration, conversion rate and expiry dates of M Points/M Coins/missions/Paid Membership/Mira Commune/Rewards/offers, redemption and collection of Rewards and offers, termination of Membership or any other items.  It is the responsibility of Members to keep up to date in respect of the Program and these Terms and Conditions. By logging in, redeeming or using M Points/M Coins, rewards and offers will be deemed as acceptance of all amendments or modifications. The Company will not be liable for any loss or damage resulting from the amendments or modifications.

12.5. Any Members may terminate Membership by giving written notice to the Company by sending an email to cs@miplus.com.hk.

12.6. Upon withdrawal, termination or expiry of Membership, all unredeemed M Points/M Coins/ Rewards/offers in the Member’s account will be forfeited and become non-refundable absolutely without prior notice. Termination of Membership does not mean withdrawal of consent to use of the Member's personal data for the purpose of marketing activities. If a Member wishes to withdraw his or her consent to the use of his or her personal data, please send an email to privacy@mirmar-group.com or as indicated in the relevant materials.

12.7. Membership is for the sole and exclusive use by Members. Members should keep their Member information confidential and secure. Members shall not allow other persons to use the App.

12.8. The Company and the Group is not liable for any case of network problems, system malfunctioning, poor phone reception or interference caused by third party applications that may result in the delay, loss, mistake, corruption or leaking of an information transfer. The Company takes no responsibility for undeliverable SMS, push notifications, emails or postal communications.

12.9. The Company and the Group and their respective employees, agents or contractors do not accept any responsibility whatsoever for unavailability of the App, or any difficulty or inability to download, upload or access to content or any other communication system failure which may render the App unavailable.

12.10. Where the App provides links to third party websites, these are provided solely as a convenience to Members, and not affiliated to the Company or the Group. Such websites shall not in any way be regarded as endorsement of any kind by the Company or the Group approving the contents thereon. Members do so entirely at their own risk if accessing any third party websites. The Company and the Group take no responsibility for nor makes any representations, warranties or any kind of undertakings as to the availability and the contents contained in third party websites. Members shall address to the operators or owners of those websites if any questions or concerns relating to third party websites.

12.11. All questions or disputes shall be resolved by the Company in its absolute discretion. In the event of any disputes, the decision of the Company shall be final, conclusive and binding. The decision of the Company on all matters relating to, or in connection with, the Membership shall be final and binding on all parties concerned.

12.12. In case of dispute, the decision of the Company shall be final and conclusive and binding on all parties concerned.

12.13. In the event of inconsistency between English and Chinese versions of these Terms and Conditions, the English version shall prevail.

12.14. This Terms & Conditions shall be governed by the laws of Hong Kong Special Administration Region and the parties hereby submit to the non-exclusive jurisdiction of the Hong Kong courts.

12.15. A person who is not a party to this Agreement has no right to enforce any terms of this Agreement under the Contracts (Rights of Third Parties) Ordinance (Cap. 623).

12.17. The Company has the right to change these Terms and Conditions from time to time without prior notice. Any changes to these Terms and Conditions shall be uploaded to the App.
